1. What Pothole Mole is
Pothole Mole is a self-service tool that helps you organise evidence and draft a claim letter to a UK highway authority under section 58 of the Highways Act 1980. It is not a law firm, does not provide legal advice, and using it does not create a solicitor–client relationship. If your claim is complex, high-value, or involves personal injury, you should consult a qualified solicitor.
2. Where the service can be used
Pothole Mole is intended only for pothole damage claims located in England & Wales. It is not designed for claims in Scotland, Northern Ireland, or outside the United Kingdom, where different laws, procedures, and responsible authorities may apply.
3. Accuracy of drafted content
Letters, FOI requests and rebuttals produced by Pothole Mole are drafted with AI based on the information you provide. You are responsible for reviewing every draft for accuracy before sending it to a council. We make no guarantee that any claim will succeed.
4. Your responsibilities
- Provide accurate information. Fraudulent claims may be a criminal offence.
- Only upload evidence you have the right to share.
- Keep your login credentials confidential.
- Do not use the service to harass, defame, or make unlawful claims.
5. Account termination
You may delete your account at any time from Account settings. We may suspend or terminate accounts that misuse the service.
6. Liability
To the fullest extent permitted by law, Pothole Mole is provided "as is". We are not liable for any indirect or consequential loss arising from your use of the service, including any council's refusal of a claim.
7. Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
